Flood Protection Levee Easement

JOE AND JANE SMITH[INSERT PROPERTY OWNER(S) NAMES HERE],

hereby GRANT(S) to

MARIN COUNTY FLOOD CONTROL AND WATER CONSERVATION DISTRICT, a

public district of the State of California,

a Perpetual and Assignable right and non-exclusive easement in the land described in

“Exhibit A” and depicted in “Exhibit B”, attached hereto and by reference made a part

hereof, to construct, maintain, repair, operate, inspect and replace a flood protection

levee or floodwall, including all appurtenances thereto, reserving, however, to the

owners, their heirs and assigns, the right to use the surface of the land to the extent

such use does not interfere with grantee’s rights hereunder or damage grantee’s flood

control levee installed herein.

The easement expressly excludes use of the land described in “Exhibit A” and depicted

in “Exhibit B” for flood control pump stations or flood gates and does not permit access

to the property by the general public.
